Privacy Policy

On behalf of IndigoCare with its registered office at Hyundailaan 1, 3980 Tessenderlo, we are responsible for the processing of personal data as reflected in this privacy statement. 

We value your privacy and ensure that the personal data you share with us is treated with care. We explain below how we do that. If you have any questions, you can always contact us at emea@indigocare.com  

This privacy & cookie statement is provided to make you aware of how IndigoCare, collects and uses this data. This data includes (i) our website and (ii) (commercial) relationships between IndigoCare and its customers, prospects and business partners. 

IndigoCare wishes to emphasise that it endeavours at all times to act in accordance with the “Privacy Legislation”, namely (i) the Belgian Privacy Act of 8 December 1992 on the protection of privacy in relation to the processing of personal data, (ii) the EU Regulation 2016/679 of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC and (iii) the (future) Belgian legislation on the implementation of the aforementioned Regulation. Please read this Privacy Statement in conjunction with IndigoCare’s legal disclaimer and cookie policy.

1. Method of data collection

Using IndigoCare’s services, purchasing products, visiting the website, signing up for the newsletter, registering for an event and/or any form of communication with IndigoCare, implies that you expressly agree (by providing your personal data or by opting in) to the Privacy Statement and therefore to the way IndigoCare collects, uses and processes your personal data. 

2. What data is collected

The data below may be collected depending on the service in question:  

– Personal data: Name, First name, Company name, Any personal data contained in the free field of the contact form or voluntarily transferred to IndigoCare. (e.g. during correspondence) 

– Address: Residential address, Email address, Business address, Billing address 

– Number: Telephone number (landline and/or mobile), Fax, Customer number, VAT number 

– Function within the company 

– Bank details: Bank account number, Payment details 

– Communication: Communication preference, Content of messages (SMS, e-mail, chat,…), Information about communication sessions with helpdesk, Backups of customer’s telephone exchange 

If you use our website, we automatically collect the following data:  

– Type of domain name used to access the Internet (e.g. .com, .org); 

– The IP address assigned during the connection; 

– The duration of the visit to the website/page; 

– The browser used; 

– The operating system or platform installed on your computer or the access device used; 

– The search engine and meta tags used to find IndigoCare’s website on the net; 

– The type and nature of files or information downloaded. 

IndigoCare automatically collects anonymous information about how you use the website. This includes automatically recording the parts of the website visited, the web browser used and the website you visited before accessing our site. While this data does not identify you, it does enable IndigoCare to generate statistics about the use of the website. The personal data collected by IndigoCare is provided expressly and voluntarily by you. 

 3. Use of data

Your data may be used for the following purposes:  

– Marketing communication  

– Sales communication  

– Technical support 

– Sending invoices and collecting payments 

– Optimising the quality, management and content of the Website 

4. Disclosure of personal data to third parties 

IndigoCare will not share your personal data with third parties unless this is necessary for the performance of the agreement and its optimisation (including but not limited to IndigoCare itself). In this case, your personal data may potentially be shared with payment providers, software suppliers, cloud partners and transport partners. If it is necessary for IndigoCare to share your personal data with third parties in this context, the relevant party is obliged to use your data in accordance with the provisions of this Privacy Statement. 

Notwithstanding the foregoing, however, IndigoCare may disclose your personal data: 

To the competent authorities (i) when IndigoCare is required to do so by law or in connection with legal or prospective legal proceedings and (ii) in order to safeguard and defend IndigoCare’s rights. 

Where IndigoCare or substantially all of its assets are acquired by a third party, in which case your personal data collected by IndigoCare will be one of the transferred assets. 

In all other cases, IndigoCare will not sell, rent or transmit your personal data to third parties, unless it has (i) obtained your consent and (ii) entered into a data processing agreement with the third party in question, which contains the necessary guarantees regarding confidentiality and privacy-compliant treatment of your personal data.

5. Cross-border processing of personal data

Any transfer of personal data outside the European Economic Area (EEA) to a recipient domiciled or based in a country not covered by an adequacy decision issued by the European Commission will be governed by provisions of a data transfer agreement, which will either (i) contain the standard contractual clauses set out in the ‘Decision of the European Commission of 5 February 2010 (Decision 2010/87/EC)’ or (ii) provide appropriate safeguards through any other mechanism under the Privacy Act or any other regulation governing the processing of personal data. 

6. Storage of personal data

Unless a longer retention period is required or justified (i) by law or (ii) by compliance with another legal obligation, IndigoCare will only retain your personal data for the period necessary to achieve and fulfil the purposes described in this Privacy Statement under ‘3. Use of data’.

7. Your privacy rights

In the context of the processing of your personal data, you have the following privacy rights: 

– Right to access your personal data; 

– Right to rectification, completion or update of your personal data; 

– Right to have your personal data deleted (‘right to be forgotten’) (in this context, IndigoCare would like to point out that certain services will no longer be accessible or can no longer be provided if you delete, or have deleted, certain necessary personal data); 

– Right to restrict the processing of your personal data; 

– Right to portability of your personal data; 

– Right to object/resist the processing of your personal data.

If you no longer wish to receive newsletters or information about IndigoCare’s services, you may unsubscribe at any time by clicking the “unsubscribe” button provided at the bottom of any email from IndigoCare.

8. Personal data security

IndigoCare undertakes to implement appropriate and reasonable physical, technological and organisational security measures to (i) prevent unauthorised or unlawful access to your personal data, as well as (ii) prevent the loss, misuse or alteration of your personal data. 

All personal data collected by IndigoCare is stored locally. Data collected through the website is stored in a data centre within the EU. Despite (i) IndigoCare’s security policy, (ii) the controls implemented and (iii) the measures taken in this regard, a completely foolproof security level cannot be guaranteed. No form of transmission or storage over the Internet, nor any electronic storage method, is 100% secure. Therefore, IndigoCare cannot guarantee absolute security in this regard. 

Your account security depends in part on keeping your password and other account information confidential. IndigoCare will never ask for your password, nor are you required to disclose it to anyone else. However, if you have disclosed your password to a third party, this person may gain access to your account and your personal data via your password. In such a case, you are solely responsible for any actions taken using your account. IndigoCare strongly advises you to change your password immediately if you find that someone has accessed your account, and to contact IndigoCare immediately.

9. Update Privacy Statement

IndigoCare reserves the right to update this Privacy Statement by publishing a new version on the website. We strongly encourage you to regularly check the website and the specific page on which the Privacy Statement is displayed to be aware of any changes.

10. Links to other websites

The website may possibly contain hyperlinks to other websites. When you click on one of these links, you may be directed to another website or Internet resource that may knowingly or through cookies or other technologies collect information about you. IndigoCare does not assume any responsibility, liability or control over these other websites or Internet resources, or their collection, use and dissemination of your personal information. You should consult the privacy policies of these other websites and Internet resources yourself to assess their compliance with privacy laws.
